Dear Friend: For the first time since the U.S. Supreme Court made abortion legal in Roe v. Wade, a law has been enacted specifically to prohibit a safe abortion practice. With the passage of this ban on what has deceptively been called "partial birth abortion," we are moving one step closer to illegal, unsafe abortions. The bill has just been signed by President Bush. In the words of a New York Times editorial of September 19, 2003, the law represents ". . . a substantial blow against women�s reproductive freedom, a clear contradiction of Roe v. Wade." The ban provides no exception to protect the life or health of women. Again quoting the New York Times editorial, "The measure�s deceptively sweeping wording, would, in effect, overturn Roe by criminalizing many midterm abortions and by omitting any exception to protect the health of the woman." I led the battle against this ban on abortion procedures on the floor of the Senate, believing that the ban was a direct challenge to Roe v. Wade and will endanger the lives of women. Pro-choice supporters have sought some measure of consolation that Courts may well overturn this harmful legislation, as the Supreme Court did with a similar Nebraska abortion ban in Stenberg v. Carhart in 2000. We must understand that the backers of this measure have no plans to stop until they make abortion illegal and overturn Roe v. Wade. For those of us who have fought to protect a woman�s right to choose and to save women�s lives, we must redouble our efforts. This will be a priority for me in the coming months as I consider legislation and judicial nominations. You can count on me to continue the fight!
